Compliance

Compliance is the product. This page sets out the standards every publisher and advertiser in our network is held to, and how we enforce them.

Our Commitment

In lead generation, a cheap lead that was not properly consented is worth less than nothing — it is a liability that follows the buyer for years. We would rather decline volume than deliver traffic we cannot stand behind.

Every partner is vetted before activation, every lead carries a consent record, and every traffic source is subject to review for as long as it runs.

Consent Standards

We require express written consent before a consumer's information enters the network. For a consent to be valid on our campaigns it must be:

  • Clear and conspicuous. The disclosure sits adjacent to the submit action, in legible type, not buried in a footer or behind a link.
  • Specific. It names the party or parties who may contact the consumer, or links to a visible list of them.
  • Unambiguous. It states that contact may be made by automated telephone dialling system or prerecorded voice, and by text, where those channels apply.
  • Unbundled. Consent to be contacted is not a condition of purchase, and pre-ticked boxes are not accepted.
  • Recorded. The exact language shown, the page it was shown on, and the time it was accepted are all captured.

Publishers must use the consent language supplied for the campaign. Altering, shortening or relocating it is a terminable breach.

Lead Certification

We work with third-party consent verification providers so that proof of consent is independent of both the publisher and the buyer. Depending on the campaign, a delivered lead may carry:

  • A TrustedForm certificate capturing the form session
  • A Jornaya LeadiD token
  • A stored copy of the disclosure text exactly as rendered to the consumer
  • Originating URL, IP address and submission timestamp

Certificates are retained alongside the lead record so that, if a complaint arrives years later, the evidence can still be produced.

Do Not Call and Suppression

  • Records are scrubbed against the National Do Not Call Registry and applicable state registries, except where a valid express written consent supports contact.
  • Known litigator and complainer lists are applied before delivery.
  • Advertiser-supplied suppression files are honoured at the point of delivery.
  • Internal do-not-contact entries are permanent and are never aged out or re-activated.

Consumers can be added to our internal suppression list at any time by emailing privacy@drivescalemedia.com.

Publisher Vetting

Approval is manual. Before a publisher sends a single lead we review:

  • Company identity, ownership and operating history
  • The specific media properties and traffic channels to be used
  • Live examples of the creative, landing pages and consent flow
  • References from other networks where available
  • Any history of regulatory action or network removal

Approval is granted per traffic source, not per account. Adding a new source requires a fresh review.

Traffic Quality Controls

Screening runs continuously rather than as a one-off check at onboarding:

  • Bot, emulator and data-centre traffic detection
  • Duplicate detection within campaign-defined windows
  • Phone and email validity and reachability checks
  • Velocity and pattern analysis on each source
  • Geographic and demographic filtering against campaign rules
  • Manual spot-checks of landing pages still live in market

Sources that drift outside normal patterns are paused for review before volume is paid out, not after. We would rather hold a payout for a day than deliver a week of bad traffic.

Email Traffic

Where a campaign permits email promotion, publishers must comply with CAN-SPAM:

  • Accurate sender identity and non-deceptive subject lines
  • A valid physical postal address in every message
  • A functioning unsubscribe link, honoured within ten business days
  • No sending to harvested, scraped or purchased address lists
  • Advance approval of creative where the campaign requires it

Data Security

  • Encryption in transit for all lead transmission, by HTTPS or secure API
  • Role-based access, with partners scoped to only their own campaign data
  • Logging and monitoring of access to lead records
  • Periodic review of vendors that touch consumer data
  • A documented incident response process with defined notification steps

Sector and State Rules

Several of our verticals carry requirements beyond general marketing law, and campaigns in those categories carry additional controls:

  • Insurance and Medicare. Licensing checks on the buyer, approved disclosure language, and restrictions on how plans may be described.
  • Consumer finance. Care around claims of approval, rates or guaranteed outcomes.
  • Health. Restrictions on claims and on handling of health-related information.
  • State-specific rules. Including state mini-TCPA statutes that require one-to-one consent naming a single seller.

Where a state rule is stricter than the federal baseline, the stricter rule governs that traffic.

Monitoring and Enforcement

Compliance is reviewed continuously, not annually. We audit live landing pages, sample consent certificates, and track complaint and dispute rates by source.

Where we find a problem we act in proportion to it:

  • Minor or first-time issues: correction required within a defined window
  • Repeated or unresolved issues: source paused pending review
  • Fabricated consent, falsified records or fraudulent traffic: immediate termination, forfeiture of related balances, and notification of affected advertisers

Raising a Concern

If you believe traffic in our network does not meet these standards — whether you are a consumer, an advertiser, a regulator or a competitor — tell us and we will investigate.
